Officer G is employed by City A as a police officer. Prior to his current employment, he had been employed as a police officer by City B. City A has commenced an employee disciplinary proceeding against Officer G in connection with an incident which occurred on March 28, 2004 in which he is alleged to have used excessive force. In preparation for the disciplinary hearing the Board of Public Safety of City A (hereinafter "Board of Public Safety" or "Board") has applied for a judicial subpoena duces tecum to obtain Officer Gs police personnel file from City B.
