Carroll appeals from the order of the Commonwealth Court granting appellee/objector Dennis Garveys petition to set aside Carrolls Nomination Petition for the Republican nomination for the office of Representative in the General Assembly from the 117th Legislative District, Wyoming County, Pennsylvania. The effect of the order below was to strike Carrolls name from the primary ballot. For the reasons that follow, we reverse the order setting aside Carrolls nomination petition and we order that Carrolls name be restored to the primary ballot.
